FUNDAMENTAL RIGHTS (Part III, Articles 12-35) • They are justiciable — you can directly approach the courts if they are violated (Article 32). • The six Fundamental Rights: 1. Right to Equality (Articles 14-18) 2. Right to Freedom (Articles 19-22) 3. Right against Exploitation (Articles 23-24) 4. Right to Freedom of Religion (Articles 25-28) 5. Cultural & Educational Rights (Articles 29-30) 6. Right to Constitutional Remedies (Article 32). • (Right to Property was removed as an FR by the 44th Amendment.) DIRECTIVE PRINCIPLES (Part IV, Articles 36-51) • Borrowed from Ireland; they are guidelines for the State to build social and economic justice. • They are NON-justiciable — courts cannot enforce them — but are "fundamental in the governance of the country." KEY DIFFERENCES • FR are justiciable; DPSP are not. • FR aim at political democracy; DPSP aim at social & economic democracy. • FR mostly restrain the State (negative); DPSP direct the State to act (positive).
